REHS/EPH Program Week Five Practice Test

State licensing for ice cream operations is usually required for those that manufacture or distribute dairy products to other businesses. Ice cream wholesalers fit this category, since they handle the production and wholesale distribution of dairy desserts and must meet state dairy program requirements for sanitation, pasteurization records, labeling, and traceability.

Retail frozen dessert shops and soft-serve units in restaurants are treated as retail food establishments and are typically regulated by local health departments. They need retail food permits and business licenses, but not a separate state ice cream license for the product itself. Food trucks fall under mobile food vendor regulations and local health permits; their licensing focuses on operating as a mobile food business rather than obtaining a specific state ice cream license. So the facility type that requires a state license is the wholesale ice cream operation.
